Legal News: the Good, the Bad…
On Thursday, there was much jubilation in trans quarters, as a ruling came in that not only upheld the Scottish Government’s right to allow trans folk to self-id when filing in the census …but seemed to run pretty close to affirming that you are the gender you identify as, irrespective of gender recognition processes. Creds, here to Fair Play For Women, without whose assiduous work in bringing the case, we would not now have this result.
Apparently, they are appealing. (Not to me, they ain’t! Ed). Wednesday 23 February their case comes up.
Rather less good news the next day in respect of an even more arcane case brought by Lady Dorrian against the Scottish Government in respect of the Gender Representation on Public Boards (Scotland) Act 2018. TLDR: this is mostly a very technical judgment on whether the Scottish government acted lawfully in attempting to interpret the terms of the Equality Act differently.
